AUPOD.com.au is a tax and accounting digital service provider registered in Australia under ABN: 16 657 777 850, referred to throughout these Terms as “AUPOD”, “Provider”, “we”, “our”, or “us”.
These Terms and Conditions (“Terms”) establish the agreement between AUPOD and the “User”.
The “User” includes:
- Any individual or business registered on the AUPOD platform for the use of services or subscriptions
- Any individual or entity identified on a sales order or service agreement
- Any authorised person accessing the platform on behalf of a company or organisation
In these Terms, AUPOD and the User are each referred to as a “Party” and collectively as the “Parties”.
1. Acceptance of Terms
1.1. By accessing, browsing, registering for, or using any part of AUPOD services, the User agrees to these Terms in full.
These Terms apply to:
- Users accessing the platform through web, mobile, or other interfaces
- Subscribers to free, trial, or paid services
- Users lodging tax returns through AUPOD
- Individuals communicating with our support or advisory team
1.2. Use of the AUPOD platform, website, digital tools, notifications, and services is subject to these Terms and Conditions.
2. Services
2.1. These Terms govern the use of AUPOD website, software, tools, and tax or accounting services.
By using AUPOD services, the User agrees to comply with these Terms.
2.2. AUPOD provides digital tax and accounting services for individuals, freelancers, sole traders, students, side hustlers, trusts, companies, and small businesses in Australia.
Services may include:
- Individual tax return preparation and lodgement
- Bookkeeping services
- ATO compliance support
- Tax lodgement and financial reporting
- Income and expense tracking
- Deduction support and pre fill assistance
- BAS and GST services
- Rental property and investment reporting support
- Access to qualified professionals through digital communication channels
- Optional business and advanced support services
- Fee from refund payment options
2.3. AUPOD is not a law firm and does not provide legal advice or legal services unless expressly stated.
All documents and information submitted through the platform are handled securely and confidentially in accordance with our Privacy Policy.
2.4. The User agrees to provide all documents and information reasonably requested by AUPOD to support service delivery, compliance obligations, identity verification, or regulatory requirements.
2.5. Where necessary to meet legal obligations or service requirements, AUPOD may obtain professional or legal advice relating to the User’s matter. Any associated costs may be payable by the User where applicable.
3. User License
3.1. AUPOD grants the User a limited, non-exclusive, and non-transferable licence to access and use the Services solely for lawful personal or internal business purposes.
All rights, ownership, and intellectual property relating to the platform and services remain the property of AUPOD.
The User has no right to access software source code, backend systems, or proprietary technology associated with the platform.
4. Acceptable Use and Restrictions
Users must use AUPOD services lawfully, responsibly, and in compliance with Australian laws and regulations.
AUPOD reserves the right to suspend or terminate access where these Terms are breached.
4.1. User Eligibility
To use AUPOD services, the User must:
- Be at least 18 years of age
- Be an Australian resident or operate a business registered in Australia where applicable
- Hold a valid TFN or ABN where required
AUPOD reserves the right to request supporting documentation to verify information provided by the User.
Access may be restricted or terminated where false, misleading, or fraudulent information is identified.
4.2. Unauthorised Access & Commercial Use
The User must not permit unauthorised access to the Services.
Users must not:
- Republish or redistribute platform content
- Resell or sublicense services
- White label or commercially exploit platform features
- Share platform access with unauthorised third parties
4.3. Intellectual Property & Reverse Engineering
The User must not:
- Copy, modify, reproduce, or distribute platform content
- Reverse engineer or decompile software systems
- Attempt to access source code or backend systems
- Remove or alter AUPOD branding or proprietary notices
4.4. Prohibited Use
The User must not use the Services:
- In a way that causes harm, disruption, or reputational damage
- To interfere with platform integrity or security
- To create competing products or services
- For unlawful, misleading, or fraudulent activity
5. Account Creation and Responsibilities
5.1. Users must create an AUPOD account to access most services.
The User confirms that all registration information provided is accurate, complete, and current.
The User agrees to update account information promptly where changes occur.
AUPOD is not responsible for losses arising from inaccurate or outdated account information.
5.2. Users are responsible for maintaining the confidentiality of their account credentials.
Any suspected unauthorised access or security breach must be reported immediately to: consultation@aupod.com.au
AUPOD is not liable for losses resulting from failure to protect account credentials.
5.3. Certain services may require additional agreements, consents, or onboarding procedures before access is granted.
6. Pricing, Subscription, and Payments
6.1. Pricing, features, and service access depend on the selected plan or service.
Available pricing structures may include:
- One time tax lodgement services
- Monthly, quarterly, or annual subscriptions
- Fee from refund services
- Optional paid add ons and business support services
6.2. Fee From Refund Services
Where available, Users may authorise AUPOD to deduct service fees directly from their tax refund.
This option generally applies only where the expected refund exceeds the applicable minimum threshold.
Users remain responsible for payment where refunds are delayed, reduced, or denied by the ATO.
AUPOD does not guarantee refund amounts or processing timeframes.
6.3. Subscription periods apply according to the selected plan and may renew automatically unless cancelled before renewal.
Where available, Users may authorise AUPOD to deduct service fees directly from their tax refund.
6.4. Users agree to pay all applicable fees associated with selected services and subscriptions.
Recurring subscriptions may renew automatically unless cancelled before the end of the current billing cycle.
6.5. Payments may be processed securely through approved third party payment providers.
Accepted payment methods may include credit card, debit card, bank transfer, or electronic invoice.
6.6. Users authorise AUPOD to charge the nominated payment method for fees associated with selected services.
6.7. Completion of payment processing does not constitute acceptance of a service request until services commence.
6.8. All payments are processed through independent payment providers. AUPOD is not responsible for losses arising from third party payment processing systems.
6.9. All fees are exclusive of applicable taxes unless otherwise stated.
6.10. AUPOD reserves the right to suspend or terminate services where fees remain unpaid.
6.11. Outstanding amounts may be treated as payable debts where payments are reversed, declined, or unpaid.
7. Cancellation and Refunds
7.1. AUPOD reserves the right to decline service requests where necessary.
Where services have not commenced, prepaid fees may be refunded.
7.2. Users may cancel subscriptions before the next billing cycle.
Access to services may continue until the end of the active subscription period.
7.4. Refund requests must be submitted in writing within 30 days of the relevant issue.
8. Service Delivery and Limitations
8.1. AUPOD may perform scheduled maintenance or platform updates from time to time.
Reasonable efforts will be made to minimise service disruptions.
8.2. AUPOD is not responsible for interruptions caused by:
- Force majeure events
- Telecommunications failures
- Third party service interruptions
- User supplied system issues
- External technical failures beyond reasonable control
8.3. Users are responsible for reviewing and approving all information before lodgment.
AUPOD is not responsible for incorrect or incomplete information submitted by the User or for decisions made by the ATO.
8.4. AUPOD does not provide legal or financial advice unless expressly stated.
Users remain responsible for maintaining records and supporting documentation for all tax claims and deductions.
9. Data Protection and Retention
9.1. Users confirm they have the legal right to provide personal information submitted through the platform and that such disclosures comply with Australian privacy laws.
9.2. AUPOD may process and retain information necessary for service delivery, compliance obligations, operational improvement, and legitimate business purposes.
Information will not be retained longer than reasonably necessary unless required by law.
9.3. In the event of a suspected data breach involving User information, both Parties agree to cooperate reasonably in addressing applicable legal obligations.
9.4. AUPOD may engage trusted third party providers, subcontractors, or cloud systems where necessary to deliver services securely and efficiently.
10. Indemnification
10.1. The User agrees to indemnify and hold harmless AUPOD, its affiliates, employees, contractors, and representatives against claims, losses, liabilities, damages, or expenses arising from:
- Breach of these Terms
- Misuse of the Services
- Inaccurate or unlawful information provided by the User
- Violation of applicable laws or third party rights
11. Termination of Services
11.1. Either Party may terminate services by providing written notice where applicable.
11.2. Following termination, platform access may be restricted to data export functionality for a limited period.
11.3. Users remain responsible for retaining copies of important records following termination of services.
12. Force Majeure
12.1. Neither Party will be liable for delays or failures caused by events beyond reasonable control, including natural disasters, pandemics, telecommunications failures, government restrictions, or cyber incidents.
12.2. Where force majeure events continue for extended periods, either Party may terminate affected services where appropriate.
13. Notices
13.1. Formal notices under these Terms must be provided in writing through the nominated contact details of each Party.
14. Governing Laws and Jurisdiction
14.1. These Terms are governed by the laws of Australia.
Any disputes arising in connection with these Terms shall be handled in accordance with applicable Australian laws and jurisdictions.
15. Content Disclaimer
15.1. Content published on the AUPOD website, platform, or social channels is provided for general informational purposes only and does not constitute legal, financial, or professional advice.
15.2. AUPOD may contain links to third party websites or services.
AUPOD is not responsible for third party content, policies, or services accessed through external links.
16. Intellectual Property
16.1. All trademarks, branding, software, content, and documentation associated with AUPOD remain the property of AUPOD Pty Ltd or its licensors.
Users must not reproduce, modify, distribute, or exploit AUPOD intellectual property without written permission.
17. Changes to the Terms
17.1. AUPOD reserves the right to update these Terms periodically.
Where significant changes occur, Users may be notified through email, platform notifications, or website updates.
Continued use of AUPOD services constitutes acceptance of updated Terms.
